Welcome to Space Penguin. By accessing or using our game, website, or any related services (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Space Penguin ("we," "us," or "our"). If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

The Service is intended for users who are at least 13 years of age. By creating an account or using the Service, you represent and warrant that you meet this minimum age requirement.

If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. We reserve the right to request verification of age at any time and to suspend or terminate accounts that we reasonably believe belong to users who do not meet the eligibility requirements.

To access most features of Space Penguin, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

• You must not share your account credentials with any other person.
• You must notify us immediately if you suspect unauthorised access to your account.
• Each user may maintain only one active account at a time unless explicitly authorised otherwise.
• Accounts are non-transferable and may not be sold, gifted, or otherwise conveyed to another person.
• We reserve the right to reclaim usernames that violate these Terms or that we deem inappropriate.

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Service. Prohibited conduct includes, but is not limited to:

• Harassment, bullying, threatening, or intimidating other users in any form.
• Posting or transmitting content that is obscene, hateful, defamatory, or discriminatory.
• Attempting to exploit, hack, cheat, or use unauthorised third-party software to gain an unfair advantage.
• Impersonating staff members, moderators, or other users.
• Spamming chat, advertising external services, or engaging in disruptive behaviour.
• Attempting to access, scrape, or collect data from the Service by automated means without our written consent.
• Engaging in any activity that damages, overloads, or impairs the Service's infrastructure.

Violations of this policy may result in warnings, temporary suspension, or permanent termination of your account at our sole discretion.

Space Penguin may offer virtual currency, items, cosmetics, and other in-game assets (collectively, "Virtual Items"). All Virtual Items are licensed, not sold, to you. You acknowledge that Virtual Items have no real-world monetary value and cannot be exchanged for real money, goods, or services outside of the game.

Trading, selling, or auctioning Virtual Items outside of officially supported in-game mechanisms is strictly prohibited and may result in account termination.

All content within the Service — including but not limited to graphics, artwork, sound effects, music, game mechanics, and written content — is owned by or licensed to Space Penguin and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Service without our prior written permission.

Any user-generated content (such as chat messages or custom profile text) that you submit to the Service remains your property; however, by submitting it, you grant us a worldwide, royalty-free licence to use, display, and moderate it in connection with operating the Service.

We reserve the right to suspend or permanently terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, third parties, or the Service, or for any other reason we deem appropriate.

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will immediately cease, and all associated data — including Virtual Items — may be deleted.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

We make no guarantees regarding the accuracy, completeness, or reliability of any content within the Service. Your use of the Service is at your sole risk.

To the fullest extent permitted by applicable law, Space Penguin and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or relating to your access to, use of, or inability to use the Service.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, notify you via in-game announcement or email. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.
